Bar Council of India Exam Date 2012 Question Paper

Next All India Bar Examination 2012

The next All India Bar Examination (“AIBE”) will be held on January 8, 2012. The AIBE can be taken by (i) all candidates who failed to clear the earlier AIBE  (ii) new candidates who wish to take the AIBE.
In addition the AIBE will also be conducted in Tamil Nadu on the same date for all candidates who
were registered to take the AIBE on March 6, 2011 and July 24, 2011.

Registration for the AIBE  will  open on  October  7,  2011 and  close  on  December  7,  2011.  Candidates
who wish to  take  the  AIBE  on  January  8,  2012  can  apply  for the  same by  picking up application  forms from a  State  Bar  Council  ("SBC")  from  October  8,  2011  onwards, or  by  registering  online  (full  details  of the  same  will be  available  on  the  BCI  website from  October  7,  2011  onwards).

Schedule for All  India Bar  Examination Moving Forward  The  BCI  is  aware that the  process  of  enrolment  with  SBCs,  graduation  from   law  schools etc.  is currently  in  the  process of being streamlined around the AIBE  and a  correct  schedule needs  to be  put  in place  with respect  to  the AIBE  so  that law students are  able to enroll, clear  the AIBE and  start  practicing within  a  short span  of  time. From  the  next academic  year onwards  the AIBE  will be  held  in September/October  and  thereafter March/April  of every  year.  The BCI  is taking steps to put  the  systems in place  for the  same  and  discussions will  be had with SBCs/law  schools  in this  regard.

Syllabus of Delhi Judicial Service Examination - THE HIGH COURT OF DELHI

Delhi Judicial Service Preliminary  Examination Syllabus
The Preliminary Examination will be a Screening Test and will consist of one paper of multiple objective type questions carrying maximum of 200 marks. In the preliminary examination question on general knowledge and aptitude of the candidate, candidate's power of expression, flair in english, knowledge of objective type legal problems and their solutions covering Constitution of India, Code of Civil Procedure, Code of Criminal Procedure, Indian Penal Code, Contract Act, Partnership Act, Principles Governing Arbitration Law, Evidence Act, Specific Relief Act and Limitation Act will be included.
Minimum qualifying marks in the Preliminary Examination shall be 60% for General and 55% for Reserved Categories i.e. Scheduled Castes, Scheduled Tribes and Physically Handicapped (Blind/Low Vision) (Mobility not to be restricted)/Orthopaedically.
However, the number of candidates to be admitted to the Main Examination (Written) will not be more than Ten times the total number of vacancies of each category advertised

General Knowledge and Language :
This paper shall comprise of two sections.
Section I : General Knowledge : This is to test the candidate's knowledge of current affairs etc. (100 Marks)
Section II : Language (Easay, Translation and Precis Writing) : This is to test the candidate's knowledge and power of expression in English. Credit will be given both for substance and expression. Conversely deduction will be made for bad expression, faults of grammer and misuse of words etc. There will be two passage for translations one in English which will be required  to be  translated into Hindi (in Devnagri Script). The Second passage in Hindi (in Devnagri Script) shall be required to be translated into English. (150 marks)
Civil Law-I :
Indian Contract Act, Indian Sale of Goods Act, Indian Partnership Act, Specific Relief Act, Hindu Law, Mohammadan Law, Delhi Rent Control Act and Law of Torts. (200 marks)

Civil Law-II :
Civil Procedure Code, Law of Evidence, Law of Limitation & Law of Registration. (200 marks)
Criminal Law :
Criminal Procedure Code, Indian Penal Code & Indian Evidence Act. (200 marks)


Viva-Voce


1. Viva-voce will carry 150 marks. Only such candidates will be called for Viva-voce who have obtained 40% marks in each written paper and 50% marks in aggregate except in the case of candidates belonging to reserved categores i.e. Scheduled Castes, Scheduled Tribes and Physically Handicapped (Blind/Low Vision) (mobility not to be restricted)/Orthopaedically in whose case the qualifying marks shall be 35% in each written paper and 45% in the aggregate
2. A candidate of General Category must secure minimum 50% marks and a candidate of Reserved Category i.e. Scheduled Castes, Scheduled Tribes and Physically Handicapped (Blind/Low Vision) (mobility not to be restricted)/Orthopaedically must secure minimum 45% marks in Viva-Voce to be eligible for being recommended for appointment to the service.

3. The marks obtained in the Viva-voce will be added to the marks obtained in the Main Examination (Written) and the Candidate's position will depend on the aggregate of both.

HIGH COURT OF DELHI : NEW DELHI
THE HIGH COURT OF DELHI will hold Delhi Judicial Service Examination in two successive stages:-
(i) Delhi Judicial Service Preliminary  Examination (objective type with 25% negative marking) for selection for the main examination, and
(ii) Delhi Judicial Service Main Examination (Written) for selection of candidates for calling for Viva voce.
The Delhi Judicial Service Preliminary Examination (Objective Type) referred to above, will be held on Sunday, the 18th December, 2011. 
The time-scale of pay of members of the Service is Rs.  9000-14550 (prerevised)  [Revised scale (interim) Rs. 15600-39100 with Grade Pay Rs. 5400].  A candidate shall be eligible to appear in the examination if he/she is (a) a  citizen of India (b) a Law graduate from a recognized university (c) a person practising as an Advocate in India or a person qualified to be admitted as an Advocate under the Advocates Act, 1961 (d) not more than 32 years of age as on 1st  January, 2012 i.e. on the 1st day of January  following the date of commencement of the examination.  In the case of  candidates belonging to Scheduled Castes/Tribes the upper  age limit is relaxable by 5 years.  The upper age limit is also relaxable maximum by 5 years in the case of  Ex-Servicemen including Emergency Commissioned Officers and Short Service Commissioned Officers who have rendered at least 5 years military  service and have been released on completion of assignment (including those whose assignment is due to be completed within 6 months) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency, or on account of physical disability attributable to military service or on invalidment. Application form including the DJSE Registration Form can be  obtained against Demand Draft/Pay Order (non-refundable) for Rs. 600/- each for General Category candidates and Rs. 100/- for Scheduled Caste / Scheduled Tribe / Physically Handicapped [Blind/Low vision (Mobility not to be restricted) and Orthopaedically Handicapped {OA – one arm affected (Right or left), OL – one leg affected (right or left), BL  – both legs affected but not arms}]  candidates on any working day from 21.09.2011 to 20.10.2011 from 10:30 A.M. to 1:00 P.M. and 2.00 P.M. to 4:00 P.M. from the Filing Counter of Delhi High Court, or by sending, at his own risk, a self addressed envelope of 38 cm X 25 cm size with postage stamp of Rs. 60/- affixed on it along with Demand Draft (non-refundable)  of  Rs. 600/- for  General Category candidates and  Rs. 100/- for Scheduled Caste / Scheduled Tribe / Physically Handicapped  (only above said categories)  candidates, in an envelope addressed to Joint Registrar (Vig.), Delhi High Court, New Delhi, superimposed with words in bold letters,  “DJS EXAMINATION 2011”. The prescribed  Application Form alongwith instructions and DJSE Registration Form will be sent to the candidate(s) by Speed Post/Registered Post only subject to their fulfilling abovesaid requirements and no enquiry/correspondence shall be entertained in this regard.
The demand draft/pay order should be  drawn  in favour of ‘Registrar General, Delhi High Court, New Delhi’ payable at New Delhi.
Applications on the prescribed form and the DJSE Registration  Form duly filled in as per Instructions, should be  sent by “Registered Post Acknowledgement Due” addressed to the Joint Registrar (Vig.), Delhi High Court, Sher Shah Road, New Delhi  – 110 003, by designation, enclosed in the envelope  provided with the application form so as to reach him  not later than 4:00 P.M. on  22.10.2011. 
Applications  can also be submitted personally at the Filing Counter of Delhi High Court on any working day from 10:30 A.M. to 1:00 P.M. and 2:00 P.M. to 4:00 P.M. till 22.10.2011.The number of vacancies to be filled is as under:-

The aforesaid vacancies  and consequent selection/appointments, if any, will be subject to outcome of WP(C) No. 256/2010 and 2828/2010 [Transfer Case (Civil) No. 77 of 2011] pending before Hon’ble Supreme Court and WP(C) Nos. 3251/2010, 7878/2010, 997/2011, 1435/2011, 1701/2011, 1702/2011, 2156/2011 and 2317/2011 pending before Delhi High Court.  
Applications incomplete in any form or those not on the prescribed application form or not accompanied by the DJSE Registration Form  or received after the due date, are liable to be rejected summarily.
The candidates applying for the examination should ensure that they fulfil all the eligibility conditions for admission to the examination.  Their admission at all the stages of examination for which they are admitted by this Court viz. Preliminary Examination, Main Examination (Written) and the Viva-voce will be purely provisional,  subject to their satisfying  the prescribed eligibility  conditions.  If on verification at any time before or after the Main Examination (Written) and the Vivavoce, it is found  that they do not fulfil any of the eligibility conditions, their candidature for the examination shall stand cancelled without any notice or further reference.

Karnataka Judicial Services Exams Syllabus


Syllabus of Karnataka Judicial Services Examination 2011 also called Karnataka Civil Judge Junior Division 2011 Sullabus

Method of Recruitment:- By direct recruitment on the basis of
aggregate marks obtained in a competitive examination (Written and Viva-Voce) conducted by the High Court, consisting of 3 stages i.e., (a) Preliminary Examination, (b) Main Examination and (c) Viva-Voce :-

(a) PRELIMINARY EXAMINATION:-

The Preliminary Examination shall be conducted by way of
Objective Type Question Paper consisting of 100 marks and the syllabi for the said examination shall be the following, namely:-

Part-A –

Code of Civil Procedure, 1908;
Negotiable Instruments Act, 1981;
Transfer of Property Act, 1882;
Indian Contract Act, 1872;
Specific Relief Act, 1963;
Indian Constitution; and
Karnataka Rent Act, 1999.


Part-B –

Code of Criminal Procedure, 1973;
Indian Penal code, 1860; and
Indian Evidence Act, 1872.


Part-C –

General knowledge – Test of reasoning and
mental ability.


(b) MAIN EXAMINATION:-

(i) Translation Paper (Maximum Marks 100)
There will be one translation paper and the candidates will
be required to translate passages in English into Kannada
and Kannada into English. The Passages will be from
(1) Depositions, (2) Judgments and (3) Documents.

(ii) Law Paper I (Maximum Marks 100)

The Code of Civil Procedure, 1908;
The Code of Criminal Procedure, 1973;
The Indian Evidence Act, 1872;
Principles of Pleading and the Constitution of India.

(iii) Law Paper II (Maximum Marks 100)
Framing of Issues and writing of Judgments in Civil
Cases.

(iv) Law Paper III (Maximum Marks 100)

Framing of Charges and writing of Judgments in
Criminal cases.


(c) VIVA-VOCE (Maximum Marks 100)

(i) The candidates General Knowledge, grasp of principles of law
and suitability for appointment as Civil Judge shall be
tested:

(ii) Another test to test the knowledge of computer / operation of
Laptop will be conducted at the time of Viva-Voce which will
carry 25 marks.

Note: Regarding (b) and (c), such of those candidates
who desire to answer in Kannada may do so.

(d) The minimum marks for pass in the Preliminary
Examination and in each paper of the Written Examination
shall be 30 for candidates belonging to Scheduled Castes
and Schedule Tribes and 40 for others.
Provided that no candidate who has secured less than the
minimum marks specified above:
i) in any paper of the written examination shall be
eligible for Viva-Voce.
ii) in any paper of the written examination or in Viva-
Voce shall be eligible for appointment as Civil Judge.
(2) From among the candidates who are eligible for Viva-Voce as
per sub-rule II (1) (d) of Rule 5 of the Karnataka Judicial Service
(Recruitment) Rules, 2004 and (Amendment) Rules, 2011, as far as may be, such number of candidates as is equal to 7 times the number of vacancies notified, having regard to the number of vacancies in each reserved category, selected in the order of merit, shall be called for Viva-Voce examination.

Rajasthan Judicial Services Competitive Examination  2011
Examination Scheme and Syllabus:

(1) The competitive Examination for the recruitment to the post of Civil Judge shall be conducted by Recruiting Authority in two stages i.e. Preliminary Examination and Main Examination as per the Scheme specified in Schedule-IV. The marks obtained in the preliminary Examination by the candidate who are declared qualified for admission to the main examination will not be counted for determining their final merit.
(2) The number of candidate to be admitted to the main examination will be fifteen times the total number of vacancies (category wise) to be filled in the year but in the said range all those candidates who secure the same percentage of marks as may be fixed by the Recruiting Authority for any Lower range will be admitted to the main Examination.
(3) On the basis of marks secured in the main examination, candidates to the extent of three times of total number of vacancies (category wise) shall be declared qualified to be called for interview.
The competitive examination for recruitment to the post of Civil Judge shall consist of:-

(I) Written/Subjective Type

The Preliminary Examination shall be an objective type examination in which 70% weightage will be given to the subjects prescribed in syllabus for Law Paper-I and Law Paper-II and 30% weightage shall be given to test proficiency in Hindi and English language. The marks obtained in the preliminary examination shall not be counted towards the final selection.

It shall be compulsory to appear, in each and every paper of written test, and also before the Interview Board for viva-voce.

Interview:-
After the marks obtained by the candidate in written test have been received the Recruiting Authority shall call for interview such of them as have obtained a minimum of 35% marks in each of the law papers and 40% marks in the aggregate.
Provided that a candidate belonging to Scheduled Caste or Scheduled Tribe category shall be deemed to be eligible for interview if he has obtained a minimum of 30% marks in each of the Law papers and 35% marks in the aggregate:
Provided further that no candidate shall be recommended who fails to obtained minimum 25% marks in the interview.
In interviewing a candidate, the suitability for employment to the service shall be tested with reference to his record at the School, College and Univeristy and his character, personality, address and physique. The questions, which may be put to him, may be of a general nature and will not necessarily be academic or legal. The candidate will also be put questions to test his general knowledge including knowledge of current affairs and present day problems. Marks shall also be awarded for the candidate’s proficiency in the Rajasthani dialects and his knowledge of social customs of Rajasthan. The marks so awarded shall be added to the marks obtained in the written test by each candidate.
