EXAMINATION FOR RECRUITMENT OF ASSISTANT PUBLIC PROSECUTORS

Exam Pattern:
Competitive examination consisting of two parts viz. written examination and viva voce test to be
conducted by the Orissa Public Service Commission under the provisions of the Orissa State.
PLAN OF EXAMINATION :
Direct recruitment to the cadre of Assistant Public Prosecutors shall be made by the Commission through a competitive examination which shall consist of two parts; written examination and viva voce test in the manner provided in the Rules and in accordance with the syllabus as specified below:-
SYLLABUS OF THE EXAMINATION
The written examination for the post of Assistant Public Prosecutors in Group-‘B’ Service shall be on the following subjects. Each paper shall be with a duration of two and half hours.
A. PAPER-I – GENERAL ENGLISH
(a) Translation from English to Oriya of a passage consisting of - 50 marks
two hundred words and Translation from Oriya to English
of a passage consisting of two hundred words.
(b) An Essay of about 1,500 words - 50 marks
(c) Précis writing consisting of 250 words - 25 marks
(d) Comprehension (Passage of about 500 words with 5 questions) - 25 marks
PAPER II – PROCEDURAL LAWS
(a) Code of Criminal Procedure, 1973 - 50 marks
(b) Indian Evidence Act - 50 marks
(c) Drafting of Petition, pleading argument - 50 marks
PAPER III – CRIMINAL LAWS
(a) Indian Penal Code, 1860 - 100 marks
(b) Probation of Offenders Act, 1958 - 10 marks
(c) Bihar and Orissa Excise Act Chapter-VIII, Secs. 79, 84, 88 of Chapter-IX - 20 marks
(d) Orissa Forest Act - 10 marks
(e) Arms Act - 10 marks

A candidate shall answer the papers in English except for Translation into Oriya. The standard of General English shall be of Degree Course and that of other papers shall be of LL.B. Course under University Examination.
The qualifying mark in the written examination shall be 45% for calling candidates to the Viva Voce test. In case of S.C. and S.T. candidates the qualifying marks shall be 40% of the written examination.
B. VIVA VOCE TEST
There shall be 75 marks for viva voce test. A candidate failing to secure 30% marks in the viva
voce test will be made unsuitable.

1. Applications in the prescribed form are invited from candidates for admission to the
competitive examination consisting of two parts viz. written examination and viva voce test to be
conducted by the Orissa Public Service Commission under the provisions of the Orissa State
Prosecution Service Rules, 1997 (as amended from time to time) for recruitment to 189 (one hundred
eightynine) posts of Assistant Public Prosecutor in Group-B Service under Home Department by
direct recruitment in the Pay Band of Rs.9,300-34,800/- with Grade Pay of Rs.4,600/- with usual
dearness allowance and other allowances as sanctioned by Government of Orissa from time to time.

(a) Out of the vacancies mentioned above, 5 vacancies for Ex-servicemen and 2 vacancies
for Sportspersons are reserved which will be shown against such categories to which they belong.
(b) In case of non-availability of eligible and suitable women candidates belonging to the
respective category, the unfilled vacancies of that category shall be filled up by eligible and suitable
male candidates of the same category.
(c) The number of vacancies to be filled up on the basis of this recruitment is subject to
change by Government without notice, depending upon the exigencies of Public Service at the
discretion of the State Government.
3. JOB CHART :- An A.P.P. may be attached to one or more Magisterial Courts.

5. PLACE OF EXAMINATION :
The examination will be held at Balasore, Berhampur, Bhubaneswar, Cuttack and Sambalpur
depending on the number of applicants. In case sufficient number of candidates are not available for
any of the zones of Balasore, Berhampur, Bhubaneswar and Sambalpur, the candidates opting for those
zones will be accommodated at Cuttack.
6. AGE LIMITS : A candidate must not be above the age of 35 (thirty five) years and under 21
(twenty one) years of age on the 1st January, 2011. The upper age limit prescribed above will be
relaxable up to a maximum of 5(five) years, if a candidate belongs to Scheduled Caste (SC) or
Scheduled Tribe (ST) or Socially and Educationally Backward Class (S.E.B.C.) or Woman or an
eligible Ex-serviceman.
Provided that, a candidate, who comes under more than one category mentioned above,
he/she will be eligible for only one age relaxation benefit, which shall be considered most beneficial to
him/her. SAVE AS PROVIDED ABOVE, THE AGE LIMITS PRESCRIBED CAN IN NO CASE
BE RELAXED.
The date of birth entered in the High School Certificate or an equivalent certificate issued
by the concerned Board/Council will only be accepted by the Commission.
7. EDUCATION QUALIFICATION & EXPERIENCE :
(i) A candidate must possess a Bachelor’s Degree in Law from a recognized University and
(ii) Should have at least two years of experience as practicing Advocate.
8. OTHER ELIGIBILITY CONDITIONS :
(i) The candidate must be a citizen of India;
(ii) The candidate must be of (a) good moral character, and (b) sound physical and mental
health, good physique and active habits and free from organic defects or bodily
infirmities so as not to create an impairment in the due discharge of duties,
(iii) The candidate must be able to speak, read and write Oriya and must have passed with
Oriya as a language subject in the Middle English School Standard or any equivalent
examination or has been declared to have passed a test in Oriya language equivalent to
the Middle English School Standard conducted by the Board of Secondary Education,
Orissa or the Education Department of Government of Orissa, if not passed H.S.C. or
equivalent Examination having Oriya as one of the subjects,
(iv) A person, who has more than one spouse living will not be eligible for appointment
unless the State Government has exempted his/her case from operation of this
limitation for any good and sufficient reason(s),
(v) If a candidate has, at any time, been debarred for a certain period/chance(s) by the
Orissa Public Service Commission or other State Public Service Commission or
U.P.S.C. from appearing at any Examination/Selection, he/she will not be eligible for
such recruitment for that specified period/chance(s).
(vi) Only those candidates, who are within the prescribed age limit and possess the requisite
qualification, Bar experience and fulfil other eligibility conditions by the closing date
of receipt of application, will be considered eligible,
(vii) The selected candidates must be physically fit and shall be required to appear before the
State Medical Board before final appointment,
9. OTHER CONDITIONS :
(a) The provisions of the Orissa Conduct of Examinations Act, 1988 (Orissa Act-2 of 1988) are
applicable to this examination conducted by the Orissa Public Service Commission. Any
violation of the provisions of the above Act and violation of instruction to candidates (as
provided in the advertisement, application form, admission certificate and answer scripts etc.)
will be seriously viewed and disciplinary action will be taken against the concerned candidates
as deemed proper.
(b) A candidate found guilty of seeking support for his/her candidature by offering illegal
gratification or applying pressure on any person connected with the conduct of the recruitment
process or found indulging in any type of malpractice in the examination or in course of the
selection process or otherwise, shall, in addition to rendering himself/herself liable to criminal
prosecution, be disqualified not only for the recruitment for which he/she is a candidate, but
also may be debarred, either permanently or for a specific period, from any recruitment or
selection to be conducted by the Commission;
(c) The period of probation is for two years. The appointing authority may extend the period of
probation or terminate the service of a person.
(d) Applications found to be incomplete in any respect are liable to rejection without entertaining
any correspondence with the applicants on that score;
(e) Admission to the recruitment will be provisional. If on verification at any stage before or after
the Viva Voce Test, it is found that a candidate does not fulfil all the eligibility conditions,
his/her candidature will be liable to rejection. Decision of the Commission in regard to
eligibility or otherwise of a candidate shall be final;
(f) This advertisement should not be construed as binding on the Government to make
appointment,
(g) The S.E.B.C./S.C./S.T. categories of candidates of ORISSA only are required to furnish copy
of Caste/Tribe certificate from competent authority. The Ex-servicemen are required to attach
copy of discharge certificate issued by the competent military authority. Sportspersons are
required to attach copy of Sports Certificate issued by the Director of Sports, Orissa.
(h) Mere empanelment in the select list of successful candidates shall not confer any right to
appointment,
(i) Candidates must answer the papers in their own hand-writing. In no circumstances, a candidate
will be allowed the help of a scribe to write the answers for him/her,
(j) All persons appointed under the Government of Orissa on or after 1st January, 2005 shall not be
eligible for pension as defined under sub-rule(1) of Rule-3 of the Orissa Civil Services
(Pension) Rules, 1992; but shall be covered by the defined contribution pension scheme in
accordance with the Orissa Civil Services (Pension) Amendment Rules, 2005;
(k) MOBILE PHONES OR ANY OTHER COMMUNICATION DEVICES ARE BANNED IN
THE PREMISES WHERE THE EXAMINATION IS CONDUCTED BY THE COMMISSION
AND IN THE OFFICE OF THE COMMISSION.
10. CERTIFICATES AND OTHER RELEVANT DOCUMENTS TO BE ATTACHED :
The candidate is required to submit, along with the application, true copies of the following
documents duly attested by a Gazetted Officer or self certified. The candidate is also required to
mention on each document “submitted by me” and put his/her full signature on the same. He/she must
not attach the original certificates to the application. Only those, who are called for the viva voce test,
will be required to bring with them the original documents for verification on the date of the viva voce
test, before it starts, failing which he/she shall not be allowed to appear at the interview :-
(a) H.S.C. or equivalent certificate showing date of birth issued by the concerned
Board/Council;
(b) P.U./P.P./Intermediate/+2 examination certificate issued by the concerned
Board/Council;
(c) Degree Certificate issued by the University, (Not for those who have obtained
integrated Degree in Law of five years duration);
(d) Certificate of Degree in Law issued by the concerned University;
(e) Certificate of enrolment in the Bar Council;
(f) Certificate from the concerned District Judge regarding authentic evidence towards
relevant experience of 2(two) years as practicing Advocate at the Bar;
(g) Two character certificates in original issued by two respectable persons, one of which
must be from a Government servant not below the rank of Group-B service;
(h) Attested copy of Caste Certificate from competent authority in support of claim as
S.C./S.T./S.E.B.C., wherever applicable;
(i) Candidates claiming to be belonging to SC/ST/SEBC category OF ORISSA BY BIRTH
are required to enclose with the application, the copies of the relevant Caste/Tribe
Certificate issued by the competent authority as mentioned below in the prescribed
form. Candidates claiming to be belonging to S.E.B.C. category must enclose
certificates issued by the competent authority in the prescribed form within the last
three years from the date of advertisement. OBC certificate will not be accepted in
lieu of S.E.B.C. certificate.
The District Magistrate/Collector or Additional District Magistrate or Sub-
Divisional Magistrate/Sub-Collector or Executive Magistrate or Revenue Officer,
not below the rank of Tahasildar/Additional Tahasildar of the Government of
Orissa.
(j) Ex-Servicemen are required to attach copy of Discharge Certificate issued by the
Commanding Officer of the Unit last served. Sportspersons are required to attach
copies of Identity Card issued by the Director of Sports, Orissa.
(k) If a candidate claims to possess qualification, equivalent to the prescribed qualification,
the rule/authority (with number and date) under which it is so treated, must be furnished
with the application form.
(l) Oriya Test pass certificate from competent authority if not passed H.S.C. or equivalent
Examination having Oriya as one of the subjects,
(m) Three copies of recent passport size photographs with signatures on its front. One shall
be pasted at the right hand corner of the first page of the application form and other two
copies to be attached with the application.
(n) Acknowledgement Card (supplied by the office along with the application form)
mentioning particulars of present postal address, Application form no., advertisement
no. etc. and affixing postage stamp of Rs.6/- (self addressed post card with stamp of
Rs.6/- in case of candidates downloading the application form from the website of the
OPSC),
(o) One self addressed envelope (Approximately 23 C.M. X 10 C.M.),
11. EXAMINATION FEE : A candidate is required to pay a non-refundable and non-adjustable
fee of Rs.100/- (Rupees one hundred) only either in shape of deposit of the amount in the Government
Treasury under the Head “0051-P.S.C.-105-State P.S.C. Examination Fee”, or in the form of Crossed
Indian Postal Order payable to the Secretary, Orissa Public Service Commission at General Post
Office, Cuttack or Account Payee Bank Draft/Pay Order drawn in favour of the Secretary, Orissa Public
Service Commission payable at any Scheduled Bank at Cuttack. Treasury Challan with wrong
mention of Head of Account or wrong mention of designation of the authority in the I.P.O./Bank
Draft/Pay Order shall not be accepted. The original Treasury Challan/Postal Order/Bank Draft/Pay
Order, as the case may be, must be sent to the Commission along with the application. Candidates
belonging to be Scheduled Caste, Scheduled Tribe of Orissa only are exempted from payment of this
fee. Neither claim for refund of fee will be entertained nor the fee will be held in reserve for any
other recruitment/purpose. APPLICATIONS NOT ACCOMPANIED BY THE PRESCRIBED FEE
SHALL BE SUMMARILY REJECTED.
12. HOW TO APPLY : (i) Application Form : Candidates are required to apply to the
Secretary to the Commission in the prescribed form, which along with other particulars, are obtainable
in person from the Office of the Orissa Public Service Commission, 19, Dr. P.K. Parija Road, Cuttack-
753001 between 11.00 A.M. to 1.30 P.M. and 2.00 P.M. to 4.00 P.M. on any working day on cash
payment of Rs.30/- (Rupees thirty) only or by Speed/Registered Post on remittance of Rs.70/- (Rupees
seventy) only by Money-Order. Full name, address of the candidate, advertisement number and name
of the Post/Service advertised must be specified in the money-order coupon in BOLD CAPITAL
LETTERS.
(ii) If Money-Order from any candidate for supply of prescribed application form is received in
the office of the O.P.S.C. after the last date for receipt of applications, no application form will be
supplied to such candidate;
(iii) The candidates may also download the prescribed application form and copy of this Long
Advertisement from the Website of the O.P.S.C., i.e. http://opsc.nic.in. The Un-reserved and
S.E.B.C. candidates downloading the Application Form will be required to pay Rs.130/- (Rs.30/- for
prescribed application form + Rs.100/- towards Examination Fee) only in shape of Indian Postal
Order/Bank Draft/Pay Order/Treasury Challan as provided under Paragraph-11 & 12 of the
Advertisement, along with the Application form. The S.C./S.T. candidates downloading the prescribed
application form will be required to Pay Rs.30/- towards prescribed application form only in shape of
Indian Postal Order/Bank Draft/Pay Order/Treasury Challan, as the case may be, along with the
application form. The S.C./S.T. candidates are, however, exempted from paying the examination fee.
(iv) Submission of applications : Candidates are required to send their applications in the
prescribed form by Registered Post/Speed Post/Courier Service to the Secretary, Orissa Public Service
Commission, 19, Dr. P.K. Parija Road, Cuttack-753001. The Commission will not take any
responsibility if the application is not received in time. The candidates may also submit their
application in closed covers in the Office of Orissa Public Service Commission directly/personally on
or before the last date of receipt of applications at the counter. The closed envelope containing the
application must be superscribed “Application for recruitment of “Assistant Public Prosecutor”.
The candidates submitting their applications directly/personally at the Counter of Orissa Public Service
Commission will be given proper acknowledgement receipt;
13. ACKNOWLEDGEMENT OF APPLICATIONS -
On receipt of Application of a candidate, the Acknowledgement card (Post Card in case of
downloaded Application Form) submitted by him/her along with the Applications will be despatched
by the Commission’s Office to him/her. The mere fact that a candidate’s application has been
acknowledged by the Commission, does not mean that his/her candidature for the recruitment has been
accepted by the Commission.
